1. Who we are, and your agreement with us
CylinderSpot (cylinderspot.com) is operated by Evergreen Holding Company USA LLC, a Delaware limited liability company ("CylinderSpot", "we", "us"). By using this site – including submitting a quote request, claiming a supplier listing, or sending a quote – you agree to these Terms and acknowledge our Privacy Policy. If you are using CylinderSpot for a business, you confirm you are authorized to agree on that business's behalf.
2. CylinderSpot is a venue
CylinderSpot is an online marketplace that connects buyers of industrial and specialty gases with independent suppliers. We are not a gas supplier. We do not sell, produce, store, transport, or handle gases or related equipment, and we are not a party to any transaction between a buyer and a supplier. Quotes, orders, deliveries, payment, and any disputes about them are strictly between the buyer and the supplier. Buyers and suppliers pay each other directly; no buyer–supplier payments are made through this site.
3. Listings and supplier information
Supplier listings are compiled from publicly available sources and from information suppliers provide themselves. Details shown on a listing – including capabilities, products, and contact information – come from the supplier, from public sources, or from our reading of those sources. We do not verify them. Buyers are responsible for evaluating a supplier's suitability, licensing, and products before ordering. If a listing about your business is inaccurate or you want it removed, contact us and we will review it; we correct or remove listings when a request is well founded. If you believe material on this site infringes your copyright or other rights, email us at info@cylinderspot.com with details and we will review it.
4. Eligibility and business use
By using CylinderSpot you confirm you are using it for business purposes and are at least 18 years old. You are responsible for complying with all laws that apply to you, including those governing the purchase, handling, storage, and transport of gases.
5. Acceptable use
You agree not to: misuse the site or interfere with its operation; submit false or misleading information; use requests or invitations to send unsolicited marketing; harvest or scrape data at scale; or use contact details found on this site for anything other than legitimate business inquiries. When you provide contact details for someone else (for example, inviting a supplier by email), you confirm they are business contact details you are entitled to share.
6. Accounts and communications
Accounts are identified by email address, and you are responsible for the accuracy of the details you provide. Using CylinderSpot involves receiving transactional emails about your requests, quotes, and orders – these are part of how the service works.
7. Fees
Using CylinderSpot to request quotes is free for buyers. Supplier subscription fees, where applicable, are those shown on our pricing page when you subscribe or renew; we will email subscribers before any change takes effect. A supplier's subscription pays for tools on this site; it does not make the supplier our agent or partner.
8. Our content
The site's design, text, and software belong to us or our licensors. We grant you a limited right to use the site for its intended purpose. Access to the site is offered only on these Terms; automated bulk collection is not an intended purpose. Feedback you send us can be used to improve the service without obligation to you.
9. Disclaimers
The site and everything on it is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We make no promises about the accuracy of listings, the quality, safety, or suitability of any gas or product, supplier performance, or delivery. How a request reaches suppliers is an automated convenience; we make no promise that any particular supplier will see, answer, or suit a request. Suppliers on CylinderSpot are independent businesses, not our agents or partners.
10. Limits on our liability, and your responsibility
To the maximum extent the law allows: we are not liable for indirect, incidental, or consequential damages, or for the acts or omissions of buyers or suppliers; and our total liability for all claims connected to the service, taken together, is limited to the greater of the amounts you have paid us in the twelve months before the first claim, or one hundred U.S. dollars. You agree to defend us against, and hold us harmless from, third-party claims and related costs (including reasonable attorneys' fees) arising out of your transactions with other users, your breach of these Terms, or your violation of law or the rights of others. Nothing in this section limits liability that cannot lawfully be limited.
11. Ending access
We may suspend or end your access to the site, or remove any listing or content, at any time, including for breach of these Terms. The parts of these Terms that by their nature should continue – including the disclaimers, the limits on our liability, and governing law – survive any ending of access.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, and any dispute with us belongs exclusively in the state or federal courts of Delaware.
13. General
If any part of these Terms cannot be enforced, the rest still applies. These Terms and the Privacy Policy are the whole agreement between you and us about the site, and replace any earlier discussions or understandings. We may transfer our rights and duties under these Terms – for example to an affiliate, or as part of a sale or reorganization of the business – without your consent; you may not transfer yours without ours.
14. Changes, and how to reach us
